You have quite a few parties to blame (so-to-speak)
- If you are charged for an ATM owned and operated by your Bank, then needless to say, your Bank sets the charges.
- If the ATM is owned and operated by your Bank, but outside its regular geographic area, then your Bank and the Interbank Network (think Cirrus, Plus, etc.) on which the transaction is riding upon.
- It the ATM is owned and operated by another bank, then that bank, the Interbank Network and your Bank.
