Section 420 of the Indian Penal Code is always applicable. There is no legislation and/or law anywhere in the world that would prevent fraud. Fraud will always exist. It can be mitigated, controlled, but never zero.
Having said this, if you feel you've been cheated out of a commercial transaction, you can always file a complain (worse case with the Police Station), and usually with your credit card company (assuming the transaction was based on the card).
If payment is made by cheque, you can put a stop order on the cheque (i.e. cancellation).
You can always file a complain to the Securities and Exchange Board of India (SEBI) as well as the bank and the payment processor that the company may be using.
