Can they made illegal sure? Will they be, not likely.
Most US States will issue you a money transmitter license based on your application for a license.
A few US States have a no action on Bitcoin and that is understandable. A lot many are classifying it as part and parcel of regular money transmission till such time they decide to specifically include additional laws for bitcoin by name.
The big 3: New York, California and Texas are the ones that all the other States are looking to, as far as a grid reference is concerned for amending their own money transmission laws.
Unless the whole Bitcoin community royally screws-up, chances are Bitcoin is here to stay and slowly be inducted into the main-stream financial and banking system in a legal manner.
